  2. Public Postings

    Users should be reminded that any Personally Identifiable Information that is voluntarily posted or shared by a user to a public area of the Website (for example, a posting to Facebook or chat room) might be collected and used by others. We cannot prevent such collection and use and in such cases you are responsible for ensuring the protection of your own privacy.

  3. Information Sharing and Disclosure

    Except as specifically stated in this Privacy Policy, our policy is not to share the Personally Identifiable Information collected through this Website with third parties, but we may share this Personally Identifiable Information with any affiliates of NewPath, and other companies and organizations who perform work for us under contract or sell products or services that complement our products and services. We also may disclose Personally Identifiable Information (a) in response to a subpoena, court order or legal process, to the extent permitted and required by law; (b) to protect user security or the security of other persons, consistent with applicable laws; (c) in connection with a sale, joint venture or other transfer of some or all of NewPath Learning, LLC or the assets of NewPath Learning, LLC [or any of its subsidiaries that states that it is governed by this Privacy Policy]; or (d) in order to enforce the Website`s Terms of Use. We exercise commercially reasonable care otherwise not to share, disclose or sell the Personally Identifiable Information of users to third-parties, except with the prior approval of the user.

    NewPath may use a third party service to collect anonymous visitor information like IP addresses, browser types (such as Internet Explorer, Firefox, Chrome and other browsers), referring pages, pages visited and time spent on a particular site. NewPath collects this information (a) for statistical analysis of Website page traffic patterns; (b) to administer our Website and servers; (c) to allow for auditing of our services by some third parties who have that right; and (d) for internal purposes to make business and marketing decisions.

    For School Administrator Subscribers, the Website may display the names, email addresses, classes, student grades and usage and usernames in teacher grade books and make them available to school administrators. Teachers can use student email addresses for communication with students regarding the lesson and administrators may access personal data generated by the Website tools for the purpose of maintaining educational records or other legitimate educational purposes. School Administrators and Teachers are responsible for ensuring the appropriate privacy of these records.

  4. For Parents and Guardians

    There are many activities on the Website in which children can participate and enjoy without having to share Personally Identifiable Information.

    NewPath will never request Personally Identifiable Information from a child in any of our public postings areas. NewPath does not require a child to disclose more Personally Identifiable Information than is reasonably necessary to participate in the on-line activity. No Personally Identifiable Information of children should be submitted to or posted on this Website by children without the consent of their parent or guardian. NewPath encourages parents to help NewPath protect their children`s privacy by instructing them never to provide Personally Identifiable Information on this Website or any other website without parental permission.

    For those activities that require Personally Identifiable Information, such as contests and sweepstakes, in compliance with the Federal Trade Commission's Children's Online Privacy Protection Act, NewPath will not condition a child's participation in an activity on that child disclosing more Personally Identifiable Information than is reasonably necessary to administer the activity. For certain online activities, NewPath may require parental consent before collecting or using Personally Identifiable Information from children under the age of 13. With these activities, NewPath will notify the respective parent of our Privacy Policy and obtain verifiable parental consent before collecting Personally Identifiable Information from the child, unless the child's name and online contact information are collected to:
    1. obtain parental consent or provide parents with notice;
    2. respond directly on a one-time basis to a child's specific request;
    3. respond more than once to a child's specific request along with providing parental notice of such use;
    4. protect the safety of a child; or
    5. comply with legal requirements. When we provide parents with notice and/or seek consent, NewPath also gives parents the ability to communicate if they do not want any further use made of the Personally Identifiable Information have collected from their child.

    Parents can request to review or have deleted their child's Personally Identifiable Information from NewPath's records, and refuse to permit further use or collection of a child's Personally Identifiable Information by writing to us at:

               NewPath Learning, LLC
               Re: Parent's Request for Information
               760C Canning Parkway,
               Victor, NY 14564,

    Parents can also print, complete and return this letter to the specified address. Unless NewPath indicates otherwise and obtains prior parental consent, Personally Identifiable Information collected from children under the age of 13 will be used solely by NewPath and/or NewPath`s agents for internal purposes and will not be sold or otherwise transferred to third parties. It is NewPath's policy never to post on its Website more than a child's first name, first initial of last name, state, age or grade.

  5. For Students/Children

    Please do not give your full name, email address, home address, telephone number or any other Personally Identifiable Information that would enable someone to contact you either on-line or off-line, without first obtaining permission from your parent or guardian and teacher.

    We do not knowingly collect Personally Identifiable Information from children on this Website, either directly, indirectly, actively or passively, except when a child may voluntarily submit such information through a "Contact Us" link on the Website or a public posting area on the Website, if such feature is available. If a child emails NewPath via a "Contact Us" link on any child-directed area of this Website and the sender can be identified as a child, any Personally Identifiable Information submitted will only be used to respond on a one-time basis to such child. In addition, if NewPath has actual knowledge that a child is sending or posting Personally Identifiable Information on any area of this Website, NewPath will use commercially reasonable efforts to delete such Personally Identifiable Information before it is made public. Please note that any online store that may be accessed from the Website is intended for parents, teachers and other adult purchasers over the age of 18 and requires the submission of Personally Identifiable Information to fulfill and service any transactions.

    NewPath may disclose a child`s Personally Identifiable Information if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users, or anyone else that could be harmed by such activities. NewPath may also disclose a child`s Personally Identifiable Information when it is believed in good faith that the law requires it.

  6. For Teachers

    There are many activities on the Website that are for teachers, which enable teachers to add another dimension to their classroom and students' activities. In order to create such online classroom activities, NewPath will collect Personally Identifiable Information from teachers and have teachers provide a password to their students so that students can view lessons, assignments and perform activities online in connection with their class through the use of such password. Such passwords will only be enabled with the verifiable consent provided by teachers acting on behalf of parents.

    A teacher may revoke the consent she has provided on behalf of her students' parents, or inquire about Personally Identifiable Information that has been collected from a student on the Website, by writing to NewPath at:

               NewPath Learning, LLC
               Re: Parent's Request for Information
               760C Canning Parkway,
               Victor, NY 14564,

    When teachers register with the Website, NewPath will use their sign-in information, which contains Personally Identifiable Information, to ensure that only the teacher who has signed in has access to his or her personal areas of the Website. For example, only registered teachers are permitted to administer Class Homepages. Access to administer a teacher's Class Homepage is controlled via that teacher's personal username and password, which was established during the registration process. FOR CHILDREN, remember to be smart online. Do not give out your full name, email address, home address, telephone number or any other personal information that would enable someone to contact you either online or offline, without first obtaining permission from your parent or guardian. Sometimes the Website will ask you for your first name and email address along with your parents' email address. We do this so that we can contact your parent(s)/guardian(s) to let them know that you have communicated with us, and that this information has been collected from you.

  7. Non-Personally Identifiable Information and the Use of Cookie Technology

    NewPath collects Non-Personally Identifiable Information (defined below) through the use of a software technology called "cookies," and through visitors' voluntary submissions and/or upon our request. Non-Personally Identifiable Information refers to information about our visitors' browsers (e.g., Chrome, Firefox, Internet Explorer and other browsers), operating systems (e.g., Microsoft Windows or Mac OS X), Internet service providers and other similar information which is tracked in aggregate form. Non-Personally Identifiable Information is also collected in connection with content submissions, games, classrooms, and communities (first name only and first initial of last name, screen names, state, age, and grade).

    The Non-Personally Identifiable Information that is tracked is anonymous and will never be identified or lead back to any visitor. Cookie technology helps us to know how many people visit us and where visitors go on our Website. Cookies are small bits of information sent to your computer. Among other things, this Non-Personally Identifiable Information allows NewPath to know which areas are favorites, which areas need improvement, or what technologies and Internet services are being used by our visitors so that online experiences may continually be improved.

    NewPath reserves the right to monitor your use of the Website to determine if you are complying with our terms and the rights, in its sole discretion, to terminate your access to the Website.

  8. Use of IP addresses

    NewPath collects IP addresses to obtain aggregate information on the use of the Website. An IP address is a number assigned to your computer by a Web server when you're on the Web. When you are on our Website, a back-end server logs your computer's IP address. This information is only used in the aggregate, such as how many users entered a specific area of our Website, and not to track a specific IP address to identify an individual user. However, such information may be used to identify a user if it is felt that there are or may be safety and/or security issues or to comply with legal requirements and/or ensure compliance with our Terms and Conditions of Use Agreement.

  9. Security

    NewPath ensures that all Personally and Non-Personally Identifiable Information that it receives via the Internet is secure and confidential against unauthorized access. This information is kept in a safe and secure system isolated from direct connection to the Internet. NewPath will give out personal information as required by law, for example to comply with a court order or subpoena or to assist in criminal investigations. NewPath may also give out personal information when deemed advisable in order to protect the safety and security of the Website and visitors to the Website. NewPath uses secure server software over a Secure Socket Layer (SSL) line to protect your credit card information. It encrypts all of your personal and credit card information so that this information cannot be read as it travels to our ordering system, and once it is received, it is stored in a location not accessible via the Internet. Note that, in the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures.

  10. Links to Other Sites

    Visitors will find links from the Website to independently owned, controlled and/or managed World Wide Web or Internet sites whose content has been found to be of possible interest to our visitors.

    The information practices of third party websites are not covered by this Privacy Policy or any other policies or terms of this Website. Be sure that you know the terms of use and privacy policy of any linked website before using it.

    In many cases, but not always, the links represent cooperative projects or mutual links established with the organizations connected with these sites. While we initially visit these sites to which we directly link, please note that we do not monitor or control the content that appears on these sites and such content may be constantly changing. We recommend that children check with their parents or teachers before clicking on links to any new sites, and we encourage all end users of the Website to read the privacy policies of all linked sites before navigating through them. Please note that we may revise this Privacy Policy without notice to users as the content on our Website continues to change and we will post all such material changes on this Privacy Policy.
